b) Having considered the above as an integral and fundamental part of the relationship between Aymara s.r.l. and the Customer, it is noted that with each purchase of products through the site the following conditions apply.

1.1. « Site » is the website https://www.erbariotoscano.it, dedicated to the sale of Erbario Toscano brand products and cosmetics and distributed exclusively by Aymara Italia s.r.l.
1.2. « Customer » is the subject (natural or legal person) who makes the purchase on the Site, accepting the general conditions of sale.
1.3. « Order » is the request form for the goods for sale, completed by the Customer through the Site. When the order is concluded and transmitted to Aymara Italia srl ​​it becomes a « contract ».

8.1. According to the provisions of the articles 52 et seq. Legislative Decree n. 21/2014, the Customer-consumer has the right to withdraw from the contract, without penalties and without the need to specify the reason, within and no later than fourteen (14) days from receipt of the goods, or, in the case of multiple goods ordered through a single order and delivered separately, from the day on which the Customer or a third party designated by him, other than the carrier, acquires physical possession of the last good. Return requests that meet the following requirements will be considered valid:
– items must not have been used.
– the items must be in perfect condition.

8.3. In case of valid exercise of the right of withdrawal, the Customer is required to return the goods to Aymara Italia s.r.l. via dei Ghivizzani 61, 55041 Capezzano Pianore (LU) without undue delay and in any case within the fourteen (14) days following the date on which he communicated his decision to withdraw from the contract; the deadline is considered to be met if the Customer sends the goods back before the fourteen-day period expires.

8.4. The direct cost of returning the goods is charged to the Customer. Aymara does not assume responsibility for damage, theft or loss of products during transport

8.5. The Customer is required to return the goods in an intact conservation condition and with original labels not removed. The packaging of the products must be accurate, in order to protect the original casings from damage, writing or labels. The consumer is responsible for the decrease in the value of the goods resulting from the handling of goods other than that necessary to establish the nature and characteristics.
8.6. Once received the withdrawal form correctly completed together with the written communication, Aymara Italia s.r.l. will take charge of the request waiting to receive the products and reserving the possibility to contact the Customer in case of need.
The Customer is free to choose the courier to be used for the return but must communicate it to Aymara Italia together with the tracking number of the shipment.
Where the right of withdrawal has been exercised in accordance with the aforementioned provisions, Aymara Italia s.r.l. will provide, within fifteen (15) working days from the moment of receipt made in the company, to return to the Customer all payments received, in relation to the order to which the withdrawal refers.
This refund will be made using or the same means of payment used by the Customer for the initial transaction if this does not entail costs for the Customer following the reimbursement or by agreeing with the customer an alternative means (bank transfer); however, pursuant to art. 56, paragraph III, legislative decree n. 21/2014, Aymara Italia s.r.l. withhold the reimbursement until you have received the goods.

Returns or replacements for purchases made in an Erbario Toscano store or at an affiliated retailer cannot be made through the Site. Returns or replacements for purchases made through the Site cannot be made at the Erbario Toscano or affiliated stores.
9.1. In the event that the Customer detects a lack of conformity of the product and is a consumer, he has the right to request repair or replacement without charge, where possible and not excessively expensive; if these are not possible or would be excessively burdensome, they can request an appropriate price reduction or termination of the contract. 11.1. All communications between the parties must be made in writing and sent to the address of the other indicated party, for Aymara Italia s.r.l., in these contract conditions and, for the Customer, in the order sent by the same.
12.1. The Seller Aymara Italia s.r.l., pursuant to and for the purposes of the European Directive 44/99 / EC and of the Italian Legislative Decree n. 206/2005 (Consumer Code), provides the consumer Buyer with a legal guarantee on all the products purchased for any lack of conformity that occurs within the term of 24 (twenty-four) months from the delivery of the products.
The legal guarantee allows the Purchaser, in case of product conformity defects, to obtain, by contacting the Seller directly, within a reasonable time taking into consideration the nature of the product, the repair (if and as far as possible), the replacement of the product , price reduction or contract termination.

The Seller, through its assistance service, will carry out quality checks to verify the actual non-conformity of the product and will provide feedback to the Buyer via e-mail.
In case of ascertained non-conformity of the product, the Seller will reimburse the Buyer for the shipping costs incurred for the return of the non-conforming product and, at no cost to the Buyer, to repair the product or replace it with a new product ; in this latter case, the non-conforming and replaced product will remain the property of the Seller.
The aforementioned refund will be made by bank transfer to the Buyer. It will be the Buyer’s responsibility to communicate to the Seller, again via aymaraitalia@erbariotoscano.it, the bank details to make the transfer in his favor and to ensure that the Seller is placed in a position to return the amount due.
12.2. The legal guarantee described above, in any case provided to the Consumer Buyer by the Seller, may possibly be accompanied by a further and independent conventional guarantee provided by the manufacturer of the purchased product, regulated according to the specific additional conditions that accompany and are enclosed in the product packaging .ART. 13 – APPLICABLE LAW AND JURISDICTION

13.2. For any dispute concerning the validity, execution or interpretation of the contract and its effects, it will be competent:
1.a) the Court of the place of residence or domicile of the Customer, if the Customer is a consumer and is resident or domiciled in Italy;
2.b) exclusively the Court of Lucca, in any other case.

a) Although the photos of the products presented on our site are not contractual, Erbario Toscano undertakes to faithfully reproduce the products offered and does not give rise to ambiguity about size, weight or quality.
b) The information on the composition of the product shown on our website is indicative and, although Erbario Toscano undertakes to change it in the event of any changes, it may not be updated. Tuscan Herbarium in respect of order control services, is authorized to contact the customer in all ways in order to validate a transaction and may request any document deemed useful (identity, domicile, etc.). The customer must provide the requested data within 48 working hours of the request. Any delay or refusal to transmit the requested data will result in the cancellation of the order by Erbario Toscano.
Erbario Toscano accepts cash-only cash payments for amounts of € 2,999.00 or less. The use of this form of payment, if foreseen, could lead to a payment by the customer. The courier in charge will ask the customer for the cash amount against the delivery and we suggest to prepare the exact cash as the courier does not change.


Given that:
a) Erbario Toscano receives orders from the site practically in real time and prepares them and sends them within 24 maximum 48 working hours from their receipt. Exceptions are orders placed with bank transfer payment in advance. In this case the orders are prepared and shipped as soon as the amount has been credited to our current account.

Erbario Toscano entrusts the consignment of the goods to the recipient to express couriers such as Brt, SDA, GLS, DHL which take an average of 24/48 working hours to be delivered throughout Italy except Calabria, Puglia, Basilicata, Sicily and Sardinia where the times of delivery becomes 48/72 working hours.
Remote or disadvantaged locations as well as smaller islands have delivery times that can exceed 96 working hours.
Delays in delivery may be caused by express couriers for the following reasons: incorrect or incomplete delivery address, absent / different name on the doorbell, incorrect or always free phone number entered, customer or courier contact failure in case of absent recipient, strikes , adverse weather conditions and force majeure.
If the Buyer wishes, he can monitor the progress of his shipment or arrange a delivery date / time slot, requesting the name of the courier and the tracking number from our customer service aymaraitalia@erbariotoscano.it. The number provided is intended to be active starting from the day following the day of shipment.
In case of absence of the buyer or of a person authorized to receive the goods on delivery, the express courier will provide to leave a receipt of happened passage with date, time and tracking in order to inform the customer providing the necessary data to request further information on the second delivery attempt. This generally takes place the day after the first attempt and if it does not go well, the goods are placed in the courier’s warehouse. Any third attempt must be agreed within 10 days (maximum limit of the storage period) and, if it is not successful, the goods will automatically return to the warehouse of Aymara Italia srl ​​in Via dei Ghivizzani 61, 55041 Capezzano Pianore (LU ).
Once the goods have returned, the buyer can:
1) Request the shipment again by taking on the new transport costs
2) Abandon it by requesting reimbursement of the payment made from which shipping and storage costs will be withheld.
In the case of shipments with cash on delivery, with the return of the goods to our warehouse, Erbario Toscano will block the customer’s personal data. In this case the customer can make purchases at our site exclusively by bank transfer in advance.

Upon receipt of the goods, the Customer is required to verify the absence of obvious damage to the package such as dents, tampered tape, holes in the packaging or stains, spots or other evidence that could have been determined by its tampering or from the breakage of a product inside it.
In these cases the customer has the right to refuse the package and must promptly report to our customer service the problem by sending an email to aymaraitalia@erbariotoscano.it.
If you decide to accept the package anyway it is essential, at the time of signing on the courier’s hand-held module or device, to accept with DAMAGED NECK RESERVE or WITH WET NECK RESERVE.
The non-acceptance with specific reservation of the goods by the customer completely raises both the express courier and Erbario Toscano from responsibility for any claims or requests for compensation due to the breakdown of the goods transported.
When the customer or a third party designated by him is different from the courier in charge of the service, he physically takes possession of the ordered goods, all the risks of loss or damage of the aforementioned good are forfeited.
In the moment in which the customer asks, in his absence, to leave the package in a place defined by him without claiming the affixing of the delivery signature (eg leaving the package in the garden, in the porter’s lodge, other), raises both Aymara Italia srl ​​and the courier from any kind of responsibility.

After receipt, if some or all of the goods do not meet the customer’s expectations, it will be possible to exercise the right of withdrawal within 14 days from the date of receipt of the products.
To do this you must notify the decision to withdraw from this contract through a clear and precise declaration providing all the necessary information to identify the order number, your personal data and the way in which you are required to be reimbursed (eg paypall or bank transfer) banking – in this case their bank details must be indicated) by sending it to aymaraitalia@erbariotoscano.it
The fundamental conditions for exercising the right of withdrawal are:
– Not having used / altered / damaged any of the products you intend to return.
– Prepare the goods safely inside a suitable packaging (it is possible to use the original packaging after having cleaned all the possible stickers) so that it does not move inside and is protected during the transport.
The right of withdrawal requires that the person who exercises it bears the costs for the return shipment, therefore the customer must contact a courier and communicate to the customer service aymaraitalia@erbariotoscano.it the name of the courier and the tracking number of the shipment.
Erbario Toscano will return the amounts spent by the customer, with the exception of the return shipment, only against goods in perfect condition.
As soon as we receive the goods subject to the right of withdrawal, Erbario Toscano checks that it meets the aforementioned requirements and, in the absence of non-compliance, provides for a maximum refund within 15 days.


Erbario Toscano reserves the right of ownership of the products ordered up until the time of payment by the purchaser and undertakes to correctly execute the obligations deriving from the contract. However, it reserves the right to withdraw totally or in part from its liability proving that the failed or improper performance of the contract is attributable either to the customer and to a third party involved in the contract or, in cases of force majeure (eg accidents, strikes, riots) , fires etc).
Erbario Toscano cannot be held responsible in the event of problems or damage deriving from the use of the internet.
If after opening the package you encounter problems with missing / wrong / defective goods, you can benefit from legal warranty rights by reporting the problem to the customer service aymaraitalia@erbariotoscano.it.
In these cases it is essential to send the photographic material as a demonstration of what was claimed (lack / error / defect). The request will be handled and, in the case of responsibility of Erbario Toscano, after a maximum of 15 days, the products covered by the report will be refunded or replaced and re-delivered with all the expenses related to Erbario Toscano.
Erbario Toscano reminds its customers that cosmetic products must be stored in dry places, not exposed to too high or too low temperatures and away from intense light sources (eg sunlight). They can be subject to an expiration date or an EAC (duration period following opening). Cosmetic products that have not been stored according to the specified indications will therefore be excluded from the guarantee.

The disputes or quarrels that will arise after or during a contract concluded between Erbario Toscano and the Customer can be resolved through a mediation / conciliation process. Product sales are subject to Italian law, whatever the customer’s residence or the place where the order is placed. Any dispute concerning the existence, interpretation, execution or renunciation of a contract concluded between the Customer and Tuscan Herbarium is subject to the exclusive jurisdiction of the Italian courts.
Erbario Toscano is the owner of all intellectual and industrial property rights relating to the website and to the Erbario Toscano trademarks for which they also hold the rights of use.
Access to this website does not confer any rights on intellectual property rights relating to the site, which remains the exclusive property of Erbario Toscano.
