General Conditions
General terms and conditions of sale and terms of use of the Erbario Toscano e-commerce website.

Sales Prices and Purchase Conditions
All prices displayed on the website constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code and Legislative Decree no. 70 of 9 April 2003. All prices include VAT and any other applicable taxes. Shipping and packaging costs also include VAT and any other applicable taxes and are always shown during the order process and in the final order summary.

Any additional costs (such as customs duties, local taxes, or charges related to deliveries to non-EU countries) shall be borne by the Customer. The total price shown at the end of the order will therefore include shipping costs but will not include any customs duties and/or additional sales taxes required for the import of goods into foreign territories. Customs clearance charges may vary from country to country and throughout the year; customers are therefore advised to take this into account when placing an order.

Should there be any changes in shipping costs or in the cost of the ordered goods between the time of purchase and the actual shipment, Aymara Italia Srl undertakes to promptly inform the Customer. In the event that no mutual agreement is reached regarding such changes to the original purchase proposal, Aymara Italia Srl will consider the order null and void and will refund the full amount paid, with no additional charges.

The conditions governing withdrawal and return of goods are published on this website and are always available for consultation. They have been drafted in direct reference to Legislative Decree no. 206 of 6 September 2005 (Consumer Code).

Aymara Italia Srl shall not be held responsible for delivery delays caused by factors beyond its control or by the unavailability of carriers to collect goods, particularly during peak periods such as Christmas, or in the event of natural disasters, adverse weather conditions, or other exceptional circumstances.
Customers may pay for the ordered goods using the payment methods indicated online at the time of purchase.
Placing an order on the Aymara Italia Srl e-commerce websites is binding for the Customer, who undertakes to:
– Request invoicing, if required, at the time of order or payment by sending an email to customercare@erbariotoscano.it and self-certifying the accuracy of the provided details.
– Actively cooperate in receiving the purchased goods, having read, understood and accepted the shipping rules described below.
– Avoid registering with pseudonyms or fictitious data that could hinder order processing, while remaining protected by the applicable personal data protection regulations.
Shipping Rules
Aymara Italia Srl will arrange for the prompt shipment of purchased goods according to the methods and timelines described on its e-commerce websites or as agreed directly with the Customer. If the goods are not immediately available for shipment, Aymara Italia Srl will promptly contact the Customer, who may choose to:
– Withdraw from the purchase and receive a full refund with no charges.
– Propose or accept new delivery times.
– Modify the order by purchasing different goods, paying any price difference or receiving a refund of any excess amount.

Delivery Times
Aymara Italia Srl has entered into service agreements with the carriers indicated on its websites to ensure compliance with proposed delivery times and to provide online shipment tracking. It will act in the common interest to ensure that these conditions are respected.
For the sake of clarity, delivery time is defined, in cases of recipient absence or refusal to accept the goods, as the period between the carrier taking charge of the goods and the first delivery attempt at the address provided at the time of order. This includes arrival at the street number and the release or posting of written notice confirming the delivery attempt, together with the corresponding online update by the carrier.
Customers may always request their shipment ID by contacting customercare@erbariotoscano.it, as all shipments are tracked in real time.
To ensure successful delivery, the Customer undertakes to:
– Ensure that all delivery address details are accurate, complete and up to date.
– Provide a valid telephone number for contact by the delivery agent if necessary.
– Be available to receive the shipment at the specified address or, if unavailable, provide in advance an alternative address or authorised person for collection.
– Be aware of and accept the standard delivery procedures adopted by the appointed carrier, which are recorded and made available online.
Carrier Delivery Procedure
– Collection within 24 hours of booking.
– Transfer to the branch closest to the delivery address.
– First delivery attempt with notice left if unsuccessful.
– Second delivery attempt with notice left if unsuccessful. The parcel will then be held at the carrier’s depot.
– The parcel may be collected free of charge within 24 hours of the storage notice by the Customer or an authorised person, upon presentation of valid identification.
– The parcel will be held for a maximum of five days and may be collected subject to payment of the relevant charges.
– After five days, the parcel will be returned to the sender, with all related costs charged.

Return of Shipment to Sender
In the event of return to sender, the goods will remain available to the Customer at the Aymara Italia Srl warehouse for two months from the start of storage. The Customer may collect the goods personally or via an authorised representative, or request re-shipment upon reimbursement of all additional documented costs incurred by Aymara Italia Srl.
Right of Retention
After two months and one day from the start of storage, if the Customer shows no interest in recovering the goods, Aymara Italia Srl will exercise its right of retention over both the goods and the amounts paid at the time of purchase. The matter shall then be considered conclusively settled, with no further claims by either party.

Personal Data Processing
Personal data are collected for the purposes necessary to fulfil orders and ship purchased items. Such data are processed electronically in compliance with applicable laws and may be disclosed only upon request by judicial authorities. Data may be shared with authorised parties solely for the execution of the contract and will not be disclosed for other purposes.
Data processing is carried out in accordance with Legislative Decree no. 196 of 30 June 2003 and applicable regulations, ensuring the protection of users’ rights, fundamental freedoms and dignity, with particular regard to confidentiality and personal identity. Data will be retained only for the period strictly necessary to fulfil the stated purposes. Requests for deletion of personal data must be submitted in writing via email to customercare@erbariotoscano.it.
Jurisdiction
For any dispute involving Aymara Italia Srl relating to e-commerce transactions carried out through this website, jurisdiction shall lie exclusively with the Court of Lucca.
