GENERAL CONDITIONS OF SALE
a) The products for sale on the website www.erbariotoscano.it are distributed by Aymara Italia srl, registered office in Via dei Ghivizzani n.61, 55041 Capezzano Pianore (LU), ITALY, VAT number: 02157120466, pec:email@example.com , Tel: 0039(0)584969660; Fax: 0039(0)584969598.
b) Considering the foregoing as an integral and fundamental part of the relationship between Aymara srl and the Customer, it should be noted that the following conditions apply to each purchase of products through the site.
ART. 1 – DEFINITIONS
1.1.“Site” is the website https://www.erbariotoscano.it, dedicated to the sale of products and cosmetics branded Erbario Toscano and distributed exclusively by Aymara Italia srl
1.2. "Customer" is the subject (natural or legal person) who makes the purchase on the Site, accepting the general conditions of sale.
1.3. "Order" is the request form for the goods on sale, filled in by the Customer via the Site. When the order is concluded and sent to Aymara Italia srl it becomes a "contract".
1.4. "Products" are the goods offered for sale on the Site, based on the general conditions of sale.
1.5. "Price" is the consideration for the sale of the indicated goods only.
1.6. "Contract" is the distance contract which has as its object the sale of the products, based on the general conditions of sale.
1.7. "Parties" are Aymara Italia srl and the Customer.
ART. 2 – TECHNICAL METHODS FOR CONCLUDING THE CONTRACT
2.1. The products are offered for sale on the basis of the terms and conditions set out in the contract published on the site at the time of the order.
The Seller reserves the right to modify these general conditions of sale at any time, at its discretion, without the need to provide any notice to users of the Site.
Any changes made will be effective from the date of publication on the Site and will apply only to sales concluded from that date.
The prices, the Products for sale on the Site and/or their characteristics may be subject to change without notice. Before sending the purchase order, the Consumer is invited to check this information and, in particular, the final sale price of the Products of his interest.
III. The Contract is finalized on the date of correct and punctual receipt by Aymara Italia srl of the order request using the form on the site, completed and accepted by the Customer in all its parts together with the payment of the amount for the product purchased, or by order with payment upon receipt of the goods (cash on delivery). Sending the order implies full acceptance by the customer of the conditions indicated in this document. It is understood, in any case, that the use of the products by the Customer certifies the acceptance of all contractual conditions. The Customer is responsible for the truthfulness of the information provided and acknowledges Aymara Italia srl's right to obtain any additional information for the purposes of the purchase contract, in compliance with current legislation. In the absence of receipt by Aymara Italia srl of the payment of the amount, the order will be canceled and canceled within 30 days, without any notice.
2.2. The site is dedicated to retail sales and as such is intended for the exclusive use of the Consumer, as defined therein: subjects who do not hold this qualification are invited not to execute purchase orders.
However, if the purchase of the Products should take place by a person who cannot be qualified as a Consumer, these general conditions of sale will still apply but, by way of derogation from what is generally provided for therein:
a) the purchaser will not be able to benefit from the legal guarantee of conformity on the Products;
b) the buyer will not be granted the right of withdrawal;
c) the purchaser will not be granted the conditions set out in this contract in favor of the Consumer exclusively as they are required by mandatory provisions of the law.
2.3. In order to make purchases through the Site, the legal capacity to act and the age of majority (18 years), which the Consumer declares to possess, are required.
2.4. In order to proceed with a purchase, the Customer must follow the following procedures:
(a) Connect to the website www.erbariotoscano.it
(b) Choose the product/s of interest, indicate the number of units to be purchased and select BUY.
(c) Position the cursor at the top right on SHOPPING CART and select CHECKOUT to proceed with the purchase.
At this point the SHOPPING CART page opens where it is possible to view any offers, use any discount coupons, request the gift box and, above all, check that the goods you are about to pay for are the ones chosen previously and respect the quantity desired.
(d) Select PROCEED TO PAYOUT
At this point the CHECKOUT page opens where you can proceed with the purchase as a guest, register on the site, or enter your login and password (only for already registered users). In the first two cases, the subsequent purchase phases do not change, however, registration on the site could give discounts (for example in the form of a discount coupon). In the third case, the registered customer will find all the part of his personal data pre-compiled by simply entering his login and password, while the rest of the procedure is common to the first two cases.
(e) Select "Guest" or "Register" or enter login and password (only for registered customers)
(f) (If Guest or Customer registering) Enter or (if Customer already registered) check their personal data and "flag" SELECT TO CONSENT TO THE TREATMENT OF PERSONAL DATA.
(g) At this point it is possible to decide whether to ship to a different address (gI) or use the personal data already entered as the destination address of the goods (g.II)
(gI) Keep the “flag” on SHIP TO DIFFERENT ADDRESS? and fill in all the remaining fields.
(g.II) Remove the “flag” on SHIP TO DIFFERENT ADDRESS?
(h) Complete the NOTES field, if necessary, and select NEXT
At this point the order summary appears again with the customer's personal data and any destination, the main characteristics of the selected product, the indication of the total price due, including shipping costs (only with the exclusion of any customs duties where due) and taxes. The customer is required to verify the accuracy of the personal data entered, the truthfulness of which he is responsible for, and double-check what is reported in the summary before proceeding further.
Once you finish this activity:
(i) Select "I HAVE READ AND ACCEPTED THE INFORMATION ON THE TERMS AND CONDITIONS OF SALE"
(l) Select the desired form of payment from those available and follow the relevant instructions

The completed order is transmitted and will perform the function of the purchase contract, the definitive summary page opens where the order number is also reported.
2.5. Following this, the Customer will receive, at the e-mail address previously indicated, the contract (order confirmation) which will show the type of products ordered, the price of each of them, the related taxes, delivery costs , the chosen payment method and the existence of the right of withdrawal pursuant to the following art. 8, exercisable by recurring the related conditions.
2.6. The contract is understood to be concluded and binding for the parties when Aymara Italia srl sends the customer the order confirmation to the e-mail address indicated by the same when registering on the site; payment of the amount and delivery of the product will follow. Unless specific, separate and different agreement between the Parties, the payment of the price for the product as indicated in the price list must be made by the customer at the same time as the order is sent. Each payment made by the customer is traced on a special payment register, only if expressly requested (through the appropriate order notes field or in any case no later than the end of the fiscal month in which the order was made) Aymara Italia srl will issue the related invoice. The VAT due will be applied to all invoiced amounts which, together with any other tax burden deriving from the execution of the Contract, will be charged to the Customer. In any case, the Customer now releases Aymara Italia srl from any and all liability deriving from transactions or payments made. The customer acknowledges and expressly accepts that the invoice can be sent and/or made available in electronic format. The customer who intends to pay for the product by credit card, acknowledges and accepts that the bank indicated by Aymara Italia srl stores the data of his credit card, which can be used by the customer to pay for any other product purchased from Aymara Italia srl
2.7. The contract will be archived with the Customer having the right to access it by explicit request by sending an email to firstname.lastname@example.org
2.8. The presentation of the Products on the Site, which is not binding for the Seller, represents a simple invitation addressed to the Consumer to formulate a contractual purchase proposal and not an offer to the public.
2.9. The purchase order sent by the Consumer to the Seller through the Site has the value of an irrevocable contractual proposal for 48 (forty-eight) working hours from its receipt by the Seller and is governed by these general conditions of sale, which form an integral part of the order itself and that the Consumer must accept in full without reservations.
Before being able to proceed with sending a purchase order for the Products, through the procedure provided on the Site, the Consumer will therefore be required to carefully read these general conditions of sale and the information on the right of withdrawal and to expressly accept these conditions sales generals.
The Consumer is invited to print a copy of these general conditions of sale using the appropriate print command and/or to store a copy on a durable medium of his choice.
Before definitively sending the purchase order, the Consumer is required to check the data entered in the order, which he can modify or correct for any entry errors.
2.10. No methods of ordering or purchasing by telephone or in any case different from what is indicated in the conditions of sale are foreseen and/or accepted.
ART. 3 – TIMES AND METHODS OF DELIVERY
3.1. The delivery of the products to the shipping address indicated by the customer in the order is made by express courier.
3.2. Delivery times range from a minimum of two days to a maximum of five working days from the moment Aymara Italia srl receives the payment.

In any case, delivery will take place at the latest within thirty days from the date of receipt of payment.
3.3. In the event of non-delivery of the goods within the agreed term or within the term of thirty days, the Customer must invite Aymara Italia srl to make the delivery within an additional term appropriate to the circumstances and is entitled to terminate the contract only if the additional term so granted should expire without the goods having been delivered to him.
3.4. In the event of unavailability of one or more products, which occurs after the order confirmation, Aymara Italia srl will notify the Customer via e-mail, except in any case proceeding with the shipment of the remaining products ordered by the Customer. In this case, the contract will remain valid only for the products actually shipped and the Customer will not be able to refuse partial delivery or payment for the goods actually delivered, nor will he have the right to obtain compensation or indemnity, but only to receive a refund of the price corresponding to the product or to unavailable products, where already paid.
3.5. Transport costs may vary as a result of Istat or fuel price changes with an impact on existing contracts with express couriers and/or be subject to promotions. We therefore invite you to read them when ordering.
ART. 4 – REGISTRATION
4.1. Clicking on the "Login" button will open a page dedicated to registration: the user who has not yet registered will find the appropriate "Register" item. The Customer must then enter a username, a valid e-mail address and click on the "Register" button.
The Customer will receive an e-mail at the address indicated containing the link to eventually and at any time change the password that will be automatically generated by the system. After that, you are deemed to have logged in for data entry; access necessary for the sole purpose of shipping, verification of previous orders or those in progress.
The already registered user, on the other hand, will be able to access his/her own data requested when completing the order and relating to the shipment itself; without prejudice to the fact that modification of the same is possible at any time.
Registration is free, quick and does not involve any obligation to purchase.
The Customer undertakes to communicate correct, truthful and complete data regarding: personal details, personal contact details, other information useful for fulfilling the order.
4.2. The customer is required to keep a copy of the purchase confirmation sent by Aymara Italia srl to the e-mail address indicated by the customer when registering on the site.
ART. 5 – PRICE, PAYMENT AND INVOICE
5.1. Prices are expressed in Euros (€); the amounts indicated, referring to the single article, are prices to the public, VAT INCLUDED, net of shipping costs and cash on delivery costs. Any additional costs (e.g. customs duties, if applicable) will be charged to the customer.
5.2. At the time of order confirmation, the data necessary for the shipment and invoicing of the item you wish to purchase will be requested.
The total price resulting at the end of the order will therefore only subsequently be inclusive of shipping costs, but not of any customs duties and/or additional taxes on the sale, necessary for the importation of the goods into foreign territory. Additional charges for customs clearance operations may vary and/or be subject to promotions. We therefore invite you to read them when ordering.
5.3. Payment of the price must be made according to one of the following methods:
– at the time of placing the order, for advance payment by credit card or PayPal > Advance payment with Paypal (immediate payment receipt),
– Payment by bank transfer in advance, the data for the transfer are shown on the site.
– Payment on delivery (cash on delivery)
ART. 6 – FORCE MAJEURE
6.1. In the event that the contract cannot be executed, not even in part, due to unavailability of the goods or other causes of force majeure, Aymara Italia srl will notify the Customer via email within thirty (30) days from the day of transmission of the order and will be released from all its obligations, except for the reimbursement of any sums already paid by the latter.
ART. 7 – COPYRIGHT AND TRADEMARKS
7.1. The contract does not grant the Customer any right to trademarks, logos and other distinctive signs of various kinds present on the site, nor to the relative contents.
Trademarks, logos and other distinctive signs of various kinds present on the site belong to their respective owners.
The use of trademarks, logos and other distinctive signs including reproduction on other websites by unauthorized third parties is prohibited.
The contents of the site (texts, graphics, images and animations) are protected by copyright; therefore, among other things, the reproduction of the images and their publication in any form is prohibited without the written authorization of Aymara Italia srl
ART. 8 – RIGHT OF WITHDRAWAL
8.1. Based on the provisions of articles 52 et seq. Legislative Decree n. 21/2014, the Customer-consumer has the right to withdraw from the contract, without penalties and without the need to specify the reason, within and no later than fourteen (14) days from receipt of the goods, or, in the case of multiple goods ordered through a single order and delivered separately, from the day on which the Customer or a third party designated by him, other than the carrier, acquires physical possession of the last good. In cases where the customer provides Aymara Italia srl with delivery directives that do not envisage the courier entrusting the goods to a natural person (e.g. delivery to post office boxes or delivery within private/condominium property/other) waives the possibility of exercising the right of withdrawal. Aymara italia srl, as far as possible, advises its customers against requesting these types of delivery.
8.2. Before the expiry of the term referred to in the previous point (14 days from receipt of the products), for the purpose of exercising the right of withdrawal, the Customer must:
– Download the appropriate return form available in the RIGHT OF WITHDRAWAL section
– Print it, complete it in every point and sign it.
– Send the completed and signed form attaching it to a written communication to Aymara italia srl, via dei Ghivizzani 61, 55041 Capezzano Pianore (LU) by registered mail with return receipt or by e-mail to the address firstname.lastname@example.org or by fax to 0039 0584-969598.
Return requests that meet the following requirements will be considered valid:
– the items must not have been used.
– the items must be in perfect condition.
– the items must be included together with all the advertising material (brochures/other) and any other products received free of charge (samples/products in promotion).
8.3. In case of valid exercise of the right of withdrawal, the Customer is required to return the goods to Aymara Italia srl via dei Ghivizzani 61, 55041 Capezzano Pianore (LU) without undue delay and in any case within fourteen (14) days following the date on which communicated his decision to withdraw from the contract; the term is considered respected if the Customer sends back the goods before the expiry of the fourteen-day period.
8.4. The direct cost of returning the goods is borne by the Customer. Aymara srl assumes no responsibility for damage, theft or loss of products during transport.
8.5. The Customer is required to return the goods in an intact state of conservation and with the original labels not removed. The packaging of the products must be accurate, in order to safeguard the original wrappings from damage, affixing of writings or labels. The consumer is responsible for the diminished value of the goods resulting from handling the goods other than what is necessary to establish their nature and characteristics.
8.6. Once the correctly completed withdrawal form has been received together with the written communication, Aymara Italia srl will take charge of the request while waiting to receive the products and reserving the possibility of contacting the Customer in case of need.
The Customer is free to choose the courier to be used for the return but must notify Aymara Italia together with the tracking number of the shipment.
Where the right of withdrawal has been exercised in accordance with the aforementioned provisions, Aymara Italia srl will, within fourteen (14) working days from the time of receipt of the return in the company, return all payments received to the Customer, in relation to the order to which it refers the withdrawal itself.
This refund will take place using either the same means of payment used by the Customer for the initial transaction where this does not involve costs for the Customer resulting from the refund or by agreeing an alternative means with the customer (bank transfer); however, pursuant to art. 56, paragraph III, legislative decree n. 21/2014, Aymara Italia srl has the right to withhold the refund until it has received the goods.
8.7. The right of withdrawal is only available to natural persons who act for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out, precisely referred to as consumers; therefore, resellers and companies are excluded from the right of withdrawal.
8.8. The right of withdrawal is also excluded, pursuant to art. 59 legislative decree n. 21/2014, in the case of supply of sealed goods that do not lend themselves to being returned for hygienic reasons or connected to health protection and which have been opened after delivery and in any case in all cases provided for by law.
8.9. No refunds or replacements are made on customized products at the express request of the customer. No refunds will be made for any products at a discounted price, but replacements with goods of corresponding value are possible.
8.10 The above provisions apply only to products purchased on the Site. Products purchased in an Erbario Toscano shop will be subject to the return policies adopted by the latter. Returns or replacements for purchases made in an Erbario Toscano store or at an affiliated retailer cannot be made through the Site. Returns or exchanges for purchases made through the Site cannot be made in Erbario Toscano or affiliated stores.
T. 9 – CUSTOMER'S RIGHTS IN THE EVENT OF NON-CONFORMITY OF THE PRODUCTS.
9.1. In the event that the Customer recognizes a lack of conformity of the product and is a consumer, he has the right to request its repair or replacement free of charge, where possible and not excessively expensive; if these are not possible or would be excessively burdensome, he may request a reasonable reduction in the price or termination of the contract. This notification must be made by sending an email to email@example.com and must contain all the elements necessary to be able to proceed with its evaluation (Name, Surname, telephone, email, order number, products subject to the discrepancy, description of the discrepancy and PHOTO where the problem is highlighted).
However, the termination of the contract is excluded in the event of minor conformity defects.
9.2. Following the report accompanied by photos and other supporting elements, Aymara Italia srl will evaluate it within a reasonable time and, after verifying the existence of the discrepancy, agree with the Customer whether to replace the non-conforming product or refund the full price. ; in any case, Aymara Italia srl has the right to propose alternative remedies available, such as, by way of example, the replacement of the product with another of a different nature but equivalent value, chosen from those displayed on the site; in the event that the Customer accepts, Aymara Italia srl will carry out the specifically proposed remedial service. In the aforementioned cases, Aymara italia srl reserves the right to send a courier in order to collect the product subject to the discrepancy which will return to being its property.

ART. 11 – COMMUNICATIONS
11.1. All communications between the parties must be made in writing and sent to the address of the other party indicated, for Aymara Italia srl, in the present contract conditions and, for the Customer, in the order sent by the same.
ART. 12 – WARRANTY
12.1. The Seller Aymara Italia srl, pursuant to and for the effects of the European Directive 44/99/CE and the Italian Legislative Decree n. 206/2005 (Consumer Code), provides the Consumer Buyer with a legal guarantee on all products purchased for any lack of conformity that occurs within the term of 24 (twenty-four) months from delivery of the products.
The legal guarantee allows the Purchaser, in case of lack of conformity of the product, to obtain, by contacting the Seller directly, within a reasonable time taking into consideration the nature of the product, the repair (if and insofar as possible), the replacement of the product , price reduction or termination of the contract.
In any case, the use of the product that does not comply with that of the product and with the instructions/warnings provided by the Seller and/or by the product manufacturer is not covered by the guarantee.
Any report of a lack of conformity of the product must be presented together with proof of purchase of the product from the Seller (tax document/invoice issued by the Seller or payment receipt).
The report of a lack of conformity, within the 24-month term mentioned above, must be sent by the Purchaser no later than 2 (two) months from the date on which the lack of conformity was found.
The report of the lack of conformity must be sent by the Purchaser to the Seller via e-mail at firstname.lastname@example.org
The Seller, through its assistance service, will carry out the quality checks aimed at verifying the effective non-conformity of the product and will provide a reply to the Purchaser via e-mail.
In the event of ascertained non-conformity of the product, the Seller will reimburse the Purchaser for the shipping costs incurred for the return of the non-conforming product and, at no cost to the Purchaser, repair the product or replace it with a new product ; in the latter case, the non-compliant and replaced product will remain the property of the Seller.
The aforementioned refund will be made by bank transfer to the Purchaser. It will be the Purchaser's responsibility to inform the Seller, always via email@example.com, of the bank details to make the transfer in his favor and to ensure that the Seller is in a position to be able to return the amount due.
12.2. The legal guarantee described above, in any case given to the Consumer Purchaser by the Seller, may possibly be accompanied by a further and autonomous conventional guarantee provided by the manufacturer of the product purchased, governed according to the specific additional conditions that accompany and are enclosed in the packaging of the product itself .
ART. 13 – APPLICABLE LAW AND JURISDICTION
13.1. The parties, entering into the contract pursuant to the previous art. 2 and anyhow provided therein, they agree that the same is governed by Italian law and subject to Italian jurisdiction, and that the application to it of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
13.2. For any dispute concerning the validity, execution or interpretation of the contract and its effects, the following will be competent:
1.a) the Court of the place of residence or domicile of the Customer, if the Customer is a consumer and is resident or domiciled in Italy;
2.b) exclusively the Court of Lucca, in any other case.
ORDER THE PRODUCTS
a) Although the photos of the products presented on our site are not contractual, Aymara Italia srl undertakes to ensure that they faithfully reproduce the products offered and do not give rise to ambiguity as to dimensions, weight, quality.
b) The information on the composition of the product shown on our site are indicative and, although Aymara Italia srl undertakes to vary them in the event of any changes, they may not be updated. In any case it is possible to contact the company directly on 0584-969660 which will always be able to provide you with correct and updated information on the components of the formulas.
c) In the presence of particular skin conditions such as allergies, we recommend that you always seek medical advice before using Erbario Toscano products.
d) The selling price of the products in € (EURO) currency is the one in force at the time of purchase, these prices do not include any additional costs for shipping and payment by cash on delivery which, if foreseen, will be added and made visible to the customer when ordering before payment. Prices include VAT.
e) The offers or promotions presented by Aymara Italia srl are valid as long as they are present on the site and within the limit of available stocks.
f) Information on product availability is provided upon acceptance of the order by Aymara Italia srl.

When the customer confirms his order, placed through the site, by clicking on "PLACE ORDER" he signs that he is aware of what is reported on the order and therefore of the personal data entered, the content, the purchase conditions, the conditions sales, prices, volumes, characteristics, qualities, payment and shipping conditions.
From that moment on, the sale will be definitive, always taking into account the possibility for the customer to exercise the right of withdrawal.
Once the order has been placed on the site, the system automatically generates a summary message of the same and sends it to the e-mail address entered in the customer's registry. The customer is required to verify that what is reported is correct and that there are no errors and to print or in any case keep the order acceptance summary email. In the event of an error in the e-mail address or failure to receive the e-mail, Aymara Italia srl assumes no responsibility.

TERMS OF PAYMENT

Aymara Italia srl, for orders placed through the website, accepts payment by credit card through the PayPal circuit, following the list of accepted cards and any limitations:
• Visa Electron
Prepaid cards, such as Postepay or Kalibra, are generally accepted on PayPal, provided that the issuing company issues an account statement in electronic or paper form, in order to be able to find the PayPal code and become a verified user. Before adding a credit or debit card to your PayPal account, make sure the card issuer offers this service.
• The registered card must belong to the PayPal account holder.
• Electronic cards generally do not offer access to your card statement, so they cannot be verified by our system.

Aymara Italia srl accepts payments by advance bank transfer which must be made to the following bank details:

Aymara Italia srl in compliance with the order control services, is authorized to contact the customer in any way in order to validate a transaction and may ask for any justification deemed useful (identity, domicile, etc.). The customer must provide the requested data within 48 working hours of the request. Any delay or refusal to transmit the requested data will result in the cancellation of the order by Aymara Italia srl.
Aymara Italia srl accepts cash on delivery payments only for amounts equal to or less than € 2,999.00. The use of this form of payment, if provided, could involve a payment contribution by the customer. The courier in charge will ask the customer for the amount in cash against the delivery and we suggest that you prepare the exact cash as the courier does not give change.
a) Aymara Italia srl receives orders from the site practically in real time and proceeds to prepare and ship them within 24 maximum 48 working hours of their receipt. Exceptions are orders placed with advance bank transfer payment. In this case, the orders are prepared and shipped as soon as the amount has been credited to our current account.

Aymara Italia srl entrusts the delivery of the goods to the recipient to express couriers such as Brt, SDA, GLS, DHL which take an average of 24/48 working hours to be delivered throughout Italy except Calabria, Puglia, Basilicata, Sicily and Sardinia where delivery become 48/72 working hours.
Remote or disadvantaged locations such as the smaller islands have delivery times that can exceed 96 working hours.
The following causes may lead to delays in delivery by express couriers: incorrect or incomplete delivery address, name on the doorbell absent/different, telephone number entered incorrectly or always free, lack of contact from customer to courier in case of absent recipient, strikes , adverse weather conditions and force majeure.
If the Purchaser wishes, he can monitor the progress of his shipment or agree on the delivery date/time slot, requesting the name of the courier and the tracking number from our customer service firstname.lastname@example.org.
